Machine Head Seek Dismissal Of Ex-Bassist’s Suit

Classic argument offered for case’s expungement

Machine Head have filed paperwork seeking the dismissal of a lawsuit filed against by their former bassist, Adam Duce.

Papers from Machine Head’s attorneys contend Duce’s suit “failed to state a claim for federal trademark infringement.”

Further, the suit claims Duce “failed to state any claim against [Machine Head’s new bassist] Jared MacEachern or [the band’s new record label] Nuclear Blast,” both of whom were listed as co-defendants in his original complaint.

That suit was filed in January, and alleges trademark infringement, breach of partnership agreement and defamation, among a litany of other things.

Duce was fired from Machine Head little more than a year ago.

Machine Head are currently working on their next LP.
